01 · Who operates this site

This website at NomadNudge is owned and operated by NomadNudge Private Limited, a private limited company incorporated in India under the Companies Act 2013, having CIN U63040HR2011PTC042985, GSTIN 06AABCT1234E1Z5, PAN AAAAA1846A, with registered office at Unit 16A, 16B & 17A, Ground Floor, Tower B-3, Spaze Itech Park, Sector 49, Gurugram (Gurgaon), Haryana 122018, India ("we", "us", "our", "the Company").

These Terms together with our Privacy Policy and Refund & Cancellation Policy form the entire agreement between you and the Company in respect of your use of this site.

02 · Definitions

Operator — the airline, hotel, or other supplier that actually delivers the travel service you book.
Booking — a reservation you make with an Operator through our platform, evidenced by a booking reference beginning GW-.
Service Fee — our flat agent fee added to every confirmed booking, currently US$ 9.50. Disclosed at checkout.
Payment Aggregator — Razorpay Software Private Limited, regulated by the Reserve Bank of India under the Payment and Settlement Systems Act 2007.
GDS — a Global Distribution System or other licensed inventory source from which fares and availability are drawn.

03 · Our role as a booking agent

We are a travel agent and booking facilitator. We do not operate aircraft, hotels, or other travel services. When you complete a booking on this site, you form a contract with the Operator on the Operator's terms (the fare rules, the room policy, the airline conditions of carriage); we are a party to the booking transaction in our capacity as agent only. Our IATA Travel Agent Registration is 28409057356 and is verifiable in the IATA agent directory.

04 · Eligibility & account

You must be at least 18 years of age, capable of forming a binding contract under the Indian Contract Act 1872, and not barred from receiving travel services under applicable law. You may use the site as a guest or create an account; in either case the information you provide must be accurate and current.

05 · Booking & ticketing

A booking is confirmed only when (i) we send you an email confirmation with a booking reference and (ii) the Operator's PNR or reservation number is included in that email. Until both happen, fares displayed on the site are quotations only and may change with Operator availability.

You are responsible for ensuring that the names on every booking exactly match the government photo ID you will present at check-in. Airlines reject travel on name mismatches and we cannot insure against this.

07 · Payment & Razorpay

Payments on this site are processed by Razorpay Software Private Limited, a Payment Aggregator regulated by the Reserve Bank of India. By submitting payment you authorise Razorpay to charge the payment instrument you provide, and you accept Razorpay's terms in addition to ours. We do not store full card numbers on our servers; tokenisation is performed by Razorpay in their PCI-DSS Level 1 environment.

08 · Cancellations & refunds

Cancellations, changes, and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. In summary: Operator rules determine refundability; we pass through what the Operator refunds, less any Service Fee component disclosed at checkout; the Service Fee is refunded in full where you cancel within 24 hours of confirmation.

09 · Third-party operators

The actual flight or stay is provided by the Operator. The Operator's terms apply to the on-the-ground experience — check-in age, baggage allowance, dress codes, ID requirements, no-show consequences. We surface the Operator's identity on every component so it is clear who you are contracting with at the gate or front desk.

10 · Errors & accuracy

We use commercially reasonable means to keep inventory and pricing accurate. In the rare case of a mismatch with the Operator at the time of booking we will, within 24 hours, either (a) honour the price displayed at the time of your booking, or (b) refund the affected component in full and leave any other component in your itinerary intact. We do not pass our errors to you.

11 · Acceptable use

You agree not to:

Breach may result in cancellation of bookings (with refund of the Operator-refundable portion only) and termination of access to the site.

12 · Liability & force majeure

To the maximum extent permitted by applicable law, our liability for any claim arising from your use of the site or any booking is limited to the value of the affected booking (excluding pass-through Operator charges that were refunded by the Operator). We are not liable for indirect, consequential, or incidental losses arising from Operator actions — delayed flights, hotel closures, missed connections on separate tickets, weather, civil unrest, government action, pandemic, or other force-majeure events. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or wilful misconduct.

13 · Intellectual property

The NomadNudge name, logos, page layouts, and original written content on this site are the property of the Company and protected under the Copyright Act 1957 and the Trade Marks Act 1999. Operator marks (airline logos, hotel chain names) are the property of the respective Operators and are used here for identification purposes only.

14 · Personal data

Your personal information is processed in accordance with our Privacy Policy and the Digital Personal Data Protection Act 2023 (DPDP Act). We act as a Data Fiduciary for the purposes of the DPDP Act. Cross-border transfers to Operators and Razorpay are disclosed in the Privacy Policy.

In accordance with Rule 5(9) of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011, and § 8(9) of the DPDP Act 2023, our Grievance Officer is:

16 · Disputes & governing law

These Terms are governed by the laws of India. Subject to the right of either party to seek interim or injunctive relief in any competent court, any dispute arising from or in connection with these Terms shall be first attempted in good faith to be resolved by negotiation. If not resolved within 30 days of written notice, the dispute shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act 1996; the seat and venue of arbitration shall be the city of our registered office; the language shall be English.

Indian consumers retain their statutory right to approach the District Consumer Disputes Redressal Commission, State Commission, or National Commission under the Consumer Protection Act 2019.

17 · Changes to these terms

If we change these Terms materially, we will post the revised version on this page at least 14 days before the change takes effect, and notify account-holders by email. Bookings confirmed before the change continue under the Terms in force at the time of confirmation. Continued use of the site after the change date constitutes acceptance.
